Who Is Responsible for a Blocked Shared Drain?

England and Wales

Ofwat explains that sewerage companies are responsible for public sewers, and that many private sewers and lateral drains transferred to them. A private drain serving one property within its boundary is normally the homeowner’s responsibility, but a shared section may fall to the sewerage company.

Scotland

Scottish Water describes the private drain from the home to the property boundary as the homeowner’s responsibility, with the public sewer network maintained by Scottish Water. Its detailed guidance also notes that layouts can be more complex.

Northern Ireland

NI Water states that it maintains the public sewer network while private drains remain the responsibility of the property owner or occupier they serve.

Before paying a contractor, check who is responsible

If several properties are backing up, or the blockage seems to be beyond your private drain, speak to the local wastewater company before paying for work. In less obvious cases they may need to check their sewer records or the actual layout on site.

Where to check the responsibility rules

A manhole in your garden does not prove the drain is yours

A manhole in your garden can sit on a public sewer, and a private drain can continue close to a boundary before it joins the adopted system. The physical position of the cover therefore does not settle responsibility by itself.

If nobody is sure where the private drain ends, the wastewater company may have sewer records. Older shared drains are not always mapped perfectly, so it also helps to know which neighbouring properties are having the same trouble.
